Rental Service Agreement

This Rental Service Agreement (“Agreement”) governs the rental services provided by TEKCE. By making a booking or using any rental services, you agree to be bound by this Agreement. It covers important details, including payments, cancellations, deposits, and guest responsibilities for short-term and long-term rentals.

1. Parties

   This Agreement applies to the individual or legal entity using TEKCE services ("Tenant" or "Guest"); and TEKCE VACATIONS HOMES L.L.C (UAE), TEKCE PROPERTY MANAGEMENT S.L (Spain), and TEKCE PROPERTY MANAGEMENT GAYRİMENKUL LTD ŞTİ (Türkiye), together with their affiliated and group companies (collectively referred to as "TEKCE").

2. Nature of Services

   TEKCE provides short-term, mid-term, and long-term rental services for properties listed on its platform.
   TEKCE acts as a rental service provider and operator, and where applicable, a property manager or authorized representative of the property owner. TEKCE may not be the legal owner of the property unless explicitly stated.

3. Booking and Contract Formation

   Short-Term Rentals
   • A booking becomes legally binding upon successful payment confirmation.
   • The Tenant accepts all listing details, pricing, and applicable conditions at the time of booking.
   Mid- and Long-Term Rentals
   • A booking is not binding until a separate written agreement is executed.
   • Additional contractual terms may apply and shall prevail in case of conflict.

4. Payments

   All payments shall be made to TEKCE. Payments may include, rental fees, security deposits, cleaning fees and/or service charges. TEKCE reserves the right to process payments, collect funds on its own behalf, and transfer funds to property owners or third parties. All prices include applicable taxes unless otherwise stated.

5. Pricing and Availability

   Prices and availability are subject to change until booking confirmation. TEKCE reserves the right to correct pricing errors, listing inaccuracies and technical issues

6. Cancellation Policy

   Cancellations and refunds are governed by the Cancellation Policy available at https://tekce.com/corporate/terms-of-use/cancellation-policy.
   Cancellation terms may vary depending on the property. By booking, the Tenant agrees to the applicable cancellation terms.

7. Security Deposit

   A security deposit may be required, particularly for mid- and long-term rentals.The deposit is collected by TEKCE and is transferred to the property owner. TEKCE does not hold the deposit and is not responsible for disputes regarding the return of deposits.

8. Insurance and Damages

   Short-term rentals may include insurance coverage; however, the Tenant remains fully responsible for any damage caused. Insurance providers may seek recovery directly from the Tenant. For mid- and long-term rentals, insurance availability may vary. Tenant responsibility remains unchanged.

9. Use of Property

   The Tenant agrees to use the property in a lawful and respectful manner, comply with occupancy limits, not sublet or assign the rental, not organize parties, gatherings, or events at the property, and/or avoid any damage, nuisance, disturbance, or illegal activity. The Tenant is responsible for any damages or losses caused during the stay.

10. Check-in and Check-out

    • Check-in: from 15:00
    • Check-out: until 11:00

    Early check-in or late check-out may be subject to availability and additional charges.

11. Cleaning and Additional Fees

    Cleaning fees are generally not included unless explicitly stated. Applicable fees are specified in each property listing and additional services may incur extra charges.

12. TEKCE Responsibilities

    TEKCE will ensure the property is available as confirmed, provide access details and necessary instructions and act in good faith in delivering rental services.

13. Relocation / Alternative Accommodation

    If the booked property becomes unavailable due to circumstances beyond TEKCE’s control (including but not limited to technical issues, owner-related issues, or force majeure), TEKCE reserves the right to provide alternative accommodation of a similar standard, or offer a full or partial refund. Such remedy shall constitute full settlement of TEKCE’s obligations.

14. Limitation of Liability

    To the maximum extent permitted by law, TEKCE shall not be liable for acts or omissions of property owners, third-party services or interruptions, utility outages and/or force majeure events.

    TEKCE’s total liability shall be limited to the total amount paid by the Tenant. To the maximum extent permitted by law, TEKCE shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profit, travel disruption, emotional distress, personal injury, health issues, or medical conditions arising out of or related to the booking, property, or stay.

15. Indemnification

    The Tenant agrees to indemnify and hold harmless TEKCE from any claims, damages, losses, or liabilities arising from misuse of the property, violation of applicable laws and/or breach of this Agreement.

16. Force Majeure

    TEKCE shall not be liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, governmental actions, war or civil unrest, infrastructure or technical failures.

17. Complaints and Claims

    Any issues must be reported to TEKCE as soon as possible during the stay. Failure to report issues in a timely manner may limit the Tenant’s ability to claim compensation.

18. Governing Law

    This Agreement shall be governed by the laws of the country where the property is located. Nothing in this Agreement shall limit any mandatory consumer protection rights applicable under local law.

19. Data Protection

    TEKCE processes personal data in accordance with applicable data protection laws, including GDPR where applicable.

20. Miscellaneous

    If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. TEKCE reserves the right to update or modify this Agreement at any time. Continued use of the services constitutes acceptance of any updates.

21. Acceptance

    By making a booking or using TEKCE rental services, the Tenant confirms that they have read, understood, and agreed to this Agreement.
